IMK successfully represented the City of Montréal before the Superior Court and the Court of Appeal in a litigation concerning the misappropriation of several million dollars in public funds resulting from a complex fraudulent scheme. The trial, which lasted nearly six months, required the presentation of extensive evidence and a forensic accounting expertise with an international component. The case raised issues of municipal law, as well as various questions of contractual and extra-contractual liability, in a context involving the solidarity of multiple actors and the application of the Act to ensure mainly the recovery of amounts improperly paid as a result of fraud or fraudulent tactics in connection with public contracts.
