Mouna Aber and Alexandre Thibault acted as independent supervising lawyers appointed by the Court in the execution of an Anton Piller order. The matter involved the decryption of proprietary software and the misappropriation of trade secrets. In this role, IMK’s lawyers acted as officers of the Court, tasked with supervising the proper execution of the order by the parties and the bailiffs. The Anton Piller order authorized IMK’s lawyers to access the defendants’ private residences and business premises, conduct searches, and seize (for copying purposes) the items identified in the judgment, including personal phones and computers. They were also responsible for safeguarding the seized evidence, ensuring the integrity of its copying and handling, and assisting in the resolution of disputes arising from the execution of the order, within the scope of the supervising lawyer’s role.
