Studios Spark Factory Inc. v. Gosselin.

In the context of a misappropriation of funds involving a former executive, IMK successfully represented a major Québec-based clothing distributor in extraordinary proceedings involving Mareva and Norwich orders. The Superior Court issued injunctive relief and pre-judgment seizure orders allowing the freezing of the defendants’ assets worldwide and preventing their dissipation. These orders were successfully renewed until the merits stage.

The case required the administration of substantial documentary evidence, supported by advanced forensic accounting expertise, which made it possible to reconstruct the structure of the fraud and trace international fund transfers. The matter also raised important issues related to employees’ right to privacy and the legitimacy of internal investigations.
