Last Friday, the Superior Court ruled that a two-parent limit is unconstitutional and struck down more than 40 articles of the Civil Code of Québec. In a ruling spanning more than 100 pages, the Honourable Justice Garin declared that these articles discriminate against multi-parent families. In so doing, the Superior Court recognized « family status » as a ground of discrimination under the Canadian Charter, for the first time in Quebec.
IMK's team, composed of Laura Cárdenas and Étienne Morin-Lévesque, represented the Association des juristes progressistes as an intervener in this litigation. The Association argued for the recognition of family status as a ground of discrimination under the Charter.
