IMK's clients were being sued for more than $450,000 under the legal warranty of quality following the sale of a house. An eight-day trial was necessary to present evidence consisting of thousands of pages and photos, in addition to six expert witnesses in construction. The Superior Court dismissed most of the plaintiffs' claims and declared their statement of claim abusive (2022 QCCS 3392). The Court of Appeal upheld the trial court's decision, including the finding of abuse of process (2023 QCCA 174).
