His practice focuses on commercial litigation, class actions, product liability, insurance law and securities litigation. He is currently involved in a number of ongoing class actions where he defends major corporations and company directors and officers.
Before joining IMK, Jean-Michel served as a clerk at the Supreme Court of Canada for the Honourable Ian Binnie and practiced commercial litigation at Sullivan & Cromwell LLP in New York City.
Jean-Michel is the co-author of three chapters pertaining to various privileges, as well as one of the chapters in the JurisClasseur Québec (Procédure Civile II) on class actions, all of which have been cited by Quebec Courts.
Bramante v. McDonald’s Restaurants of Canada Limited: McDonald’s in a class action related to claims that the advertising of toys and Happy Meals violates the Quebec Consumer Protection Act. Presently at the certification stage.
Lac Mégantic Class Action: Devlar during the certification hearing and participated in the negotiation of the settlement of the matter.
Regroupement des citoyens du quartier St-Georges inc. v. Alcoa Canada Ltd.: Alcoa Canada Ltd. in a class action concerning allegations of contamination of soil and residences in the Baie-Comeau region.
Mouvement d’éducation et de défense des actionnaires (MEDAC) v. Société financière Manuvie: Former CEO of Manulife Financial Corporation, in a class action for alleged false and misleading representations in secondary market disclosure documents.
Benadiva v. Penn West Petroleum Ltd.: Former CFO of Penn West Petroleum Ltd., in a proposed class action for alleged false and misleading representations under the Securities Act.
Roy v. Denso Corporation: Calsonic Kansei Corporation and its U.S. subsidiary in three proposed class actions against several auto parts manufacturers over price-fixing allegations.
Badamshin v. Panasonic Corporation: Nippon Chemi-Con Corporation and United Chemi-Con Corporation in a proposed class action against a large number of electronic components manufacturers over price-fixing allegations for capacitors.
