Roux v. Mashaal.

The owner of an upper property was channeling water from his backyard onto our client's lower property, who filed proceedings to force the defendant to carry out drainage work on his land. Several contested proceedings were necessary to bring this case to trial. At the conclusion of the trial, the Superior Court granted all of the detailed injunctive relief sought by IMK’s client to resolve the technical situation and found the defendant to have been abusive in the conduct of his defense (2022 QCCS 1139).
