International Air Transport Association v. Instrubel, N.V.

IMK’s client, Instrubel, obtained a pre-judgment garnishment of royalties owed by the International Air Transport Association to the Republic of Iraq in connection with the enforcement of an arbitral award. Following the invalidation of the garnishment by the Superior Court, IMK appealed to the Court of Appeal and obtained the reversal of the decision (2019 QCCA 78). The International Air Transport Association was granted leave to appeal to the Supreme Court of Canada, and IMK successfully defended its client on appeal, which was dismissed from the bench by the Supreme Court of Canada (2019 SCC 61).
