David began his legal career at IMK in 2010. His practice covers all areas of civil and commercial litigation, with special emphasis on real estate law, construction litigation and security interests, including actions based on construction hypothecs.
Over the years, he has also developed a specialization in property law, as well as in estate law. His clientele is diverse, and includes companies in the public and private sectors, particularly general contractors, but also individuals. He regularly advises general contractors during contractual negotiations.
Indigo Books & Music Inc. v. Immeubles Régime XV Inc.: Indigo in injunction proceedings dealing with the interpretation of an exclusivity clause to secure Indigo’s position in a large lifestyle centre.
Garmaise v. Nun’s Island Investments Inc.: Nun’s Island Investment Inc. in a real estate litigation on the interpretation of a commission agreement dating back to the 1960s and the initial development of Nun’s Island.
Attorney General of Canada v. Gestion 555 Carrière Inc.: AGC in a dispute concerning the opposability of an option to purchase an immoveable contained in a commercial lease.
Design & Construction Giffels Québec inc. v. Partitions G.F. systèmes intérieurs inc.: Giffels in a dispute on the scope of a construction hypothec for construction and claims that may or may not be the object of such a hypothec.
Design & Construction Giffels Québec inc. v. Tysel Construction et Rénovations inc.: Giffels in a dispute regarding the opposability of legal hypothecs published against a construction project abandoned after the client’s bankruptcy.
Hydroméga Services inc. v. EDF Énergies Nouvelles S.A.: EDF in a dispute on the interpretation of agreements made in the context of a wind farm development project in Quebec.
Groupe Yvon Michel inc. v. 9212-6192 Québec inc. (Eye of the Tiger Management): Golden Boy Promotions LLC in a dispute regarding the cancellation of a promotion agreement made between GYM and boxer David Lemieux.
