LATEST NEWS:  AUTHORIZATION OF THE CLASS ACTION

On October 4, 2022, the Quebec Court of Appeal authorized the Representative Mr. Adam Charles Benjamin to institute a class action against the following defendants:

  • Crédit VW Canada inc.
  • Toyota Crédit Canada inc.
  • Honda Canada Finance inc.
  • Corporation de services financiers Mercedes-Benz Canada
  • BMW Canada inc.
  • Services Financiers Nissan Canada inc.
  • Compagnie de Gestion Canadian Road
  • Canadian Dealer Lease Services inc.

This class action seeks reimbursement of excessive fees charged for the assignment of a vehicle lease, as well as punitive damages.

LATEST NEWS: SETTLEMENT AGREEMENT WITH CANADIAN DEALER LEASE SERVICES INC.

A Settlement Agreement has been reached with Canada Dealer Lease Services Inc. (“CDLSI”) on behalf of all persons in Québec who, between April 5, 2015, and February 2, 2023, were charged fees to transfer a long-term vehicle lease contracted with CDLSI (the “CDLSI Sub­Class Members”).

On August 31, 2023, the Court will hear the Application for Approval of the Settlement Agreement. At this hearing, the Court will determine whether the Settlement Agreement is fair and reasonable and in the best interests of the CDLSI Sub-Class Members.

If the Settlement Agreement is approved by the Court, CDLSI Sub-Class members will receive an amount of money depending on whether they fall within Compensation Group A or Compensation Group B, which are define in the following notice:

SUMMARY OF THE CLASS ACTION

The Class action alleges that the defendants required the payment of a fee for the purpose of assigning their long-term vehicle leases which exceeded the reasonable expenses that could result from the assignment of a lease. In the case of the Consumer Subclass, it is also alleged that certain defendants charged an assignment fee, the total amount of which was not precisely indicated in their long-term vehicle lease contracts in contravention of the Consumer Protection Act. The action seeks the reimbursement of the assignment fee overpaid and punitive damages.
