In Comité des citoyens inondés de Rosemont c. Ville de Montréal, 2020 QCCA 696 the Court of Appeal heard an appeal of a judgment on a motion for directives and to dismiss exhibits in a class action related to flooding. At issue was whether the individual aspects of each class member’s plumbing system was relevant at the common issues trial or at the individual recovery stage.
