Kurt joined IMK in 1998. Through the years, he has gained invaluable experience in multiple areas of law, often new and emerging ones, which have broadened his professional perspective and legal vision, allowing him to identify novel ways to solve complex problems. Litigation is at the heart of his practice, as is crisis management.
He represents corporations, organizations and individuals alike in civil and commercial disputes. Kurt also acts in matters relating to real-estate development and construction, shareholder disputes, professional liability and breach of contracts. He is often called upon to advise clients on delicate issues involving personal integrity.
Kazemi Estate v. Islamic Republic of Iran: Estate and son of the late photo-journalist Zahra Kazemi, at all levels of Court including the Supreme Court of Canada, challenging the constitutionality of Canada’s State Immunity Act in so far as it bars Civil redress for torture.
Quebec (Attorney General) v. Herrmann-Busson: Herrmann-Busson in a dispute with the Provincial Crown over the ultimate ownership of an abandoned rail bed and the interpretation of deeds dating back to the early 1900’s
Mohawk Council of Kanesatake (MCK) v. Isaacs et al.: MCK in connection with the decision-making powers of First Nations Band Councils in general, and the interpretation of a Tripartite Policing Agreement entered into with the Federal and Provincial Crowns in particular.
Certain underwriters at Lloyd’s v. Rhind: Rhind in a suit against a professional liability insurer in connection with fraudulent acts committed in the financial services industry.
Grant v. Dion: Grant in relation to the applicability of oppression and other shareholder type remedies in the realm of Quebec company law and in particular as regards limited partnerships.
Immoparc et al. v. Katz: Immoparc et al., foreign real estate investors, in the context of a professional liability suit against Quebec land surveyors.
Concupisco Inc. v. Société en commandite 407 McGill: Concupisco Inc. to obtain orders for conveyance of title (passation de titre) in the context of a strategic real estate development in Old Montreal.
